Terms of Use

These Terms of Use govern the use of the learning and training area provided by Tobias Grawinkel (nuuminds). They are intended for employees of companies and organizations that have entered into a corresponding agreement with nuuminds.

General Provisions and Scope

  1. These Terms of Use apply to the use of the learning and training area provided by Tobias Grawinkel (nuuminds).
  2. The learning and training area is intended exclusively for authorized employees of companies and organizations (hereinafter "Client Company") that have entered into a corresponding agreement with nuuminds. These Terms of Use do not establish an independent contractual relationship between nuuminds and individual users.
  3. These Terms of Use supplement the existing contract between nuumindsand the respective Client Company. They define the rules of conduct and conditions for the use of the platform by employees of the Client Company (hereinafter "Users").
  4. The Client Company is responsible for informing its employees about these Terms of Use and ensuring compliance.

Access and Login

  1. Access to the platform is set up exclusively by nuuminds or on behalf of the Client Company. Self-registration by users is not possible.
  2. Login is carried out via email. Users receive a one-time sign-in code (OTP) sent to their business email address to sign in to the platform.
  3. Each user receives a personal, non-transferable account. Sharing access with third parties (account sharing) is not permitted and may result in immediate deactivation of the account.
  4. Access is only available as long as the Client Company maintains an active agreement with nuuminds. Upon termination of the agreement, access expires automatically.
  5. Users may upload a profile picture. This picture is visible to other users within the platform. Uploading a profile picture is voluntary. Users may only upload images for which they hold the necessary rights. Offensive or inappropriate content is not permitted.

Use of the Platform and Content

  1. The platform provides digital learning content. This includes self-paced courses consisting of individual modules, which are divided into several units. Some units require tasks to be completed (e.g. quizzes or multiple-choice tests). Evaluations or surveys may also be included. Additionally, the platform offers interactive live training sessions in which moderators present content and answer user questions.
  2. Upon successful completion of courses or live training sessions, Certificates of Participation may be issued. These are personalized and may be used privately or published. Certificates of Participation do not constitute officially recognized certificates or state-accredited qualifications.
  3. Users are granted a simple, non-transferable right of use to the learning content, limited to the duration of their access to the platform. No further rights are granted.

Obligations and Rules of Conduct

  1. Users agree to interact respectfully with one another and with nuuminds. Discriminatory, offensive, or harassing statements are prohibited.
  2. Misuse of the platform is prohibited, including the distribution of malicious software, manipulation of the platform, or excessive strain on the systems.
  3. Users may not store or process personal data of other users without authorization. Violations must be reported immediately to hello@nuuminds.com.
  4. Platform content (courses, videos, documents, etc.) may only be used within the intended platform functions. Reproduction or external distribution without express consent is prohibited.

User Management by the Client Company

  1. Each Client Company receives at least one manager account. Managers are authorized to create users for their company (manually or via CSV import) and to set up groups.
  2. Within these groups, managers may appoint group leaders. Group leaders are authorized to manage users in their group and to view the learning progress and Certificates of Participation of group members.
  3. Managers may manage and view all users and their learning progress within their company. The scope of access is limited to the fulfillment of corporate training purposes.

Suspension and Termination of Access

  1. nuuminds reserves the right to temporarily or permanently deactivate the access of individual users in the event of significant violations of these Terms of Use.
  2. Users affected by a suspension will be informed of the reasons via email. The Client Company will also be notified.
  3. Access expires automatically once the Client Company no longer maintains an active agreement with nuuminds. Personal user data will subsequently be deleted or anonymised in accordance with contractual and legal requirements.

Availability and Liability

  1. nuuminds strives to ensure the highest possible availability of the platform but does not guarantee its continuous, uninterrupted accessibility. Maintenance, technical disruptions, or force majeure may lead to temporary limitations.
  2. The learning content provided on the platform is intended exclusively for educational purposes. No guarantee of specific learning outcomes is given.
  3. The liability of nuuminds towards the Client Company is governed by the respective main contract. There is no contractual liability towards individual users due to the absence of a contractual relationship.

Data Protection

  1. Personal data (first name, last name, email, profile pictures, learning progress, and Certificates of Participation) is processed exclusively for the provision and use of the platform. Evaluations and surveys are stored anonymously to improve the quality of learning offerings.
  2. Self-assessments by users are evaluated exclusively in anonymised form. Results of these self-assessments are only visible to managers or group leaders in anonymised form.
  3. nuuminds processes user data on behalf of the Client Company on the basis of a Data Processing Agreement (DPA). The Client Company remains the data controller within the meaning of the GDPR.

Changes to these Terms of Use

nuuminds reserves the right to amend these Terms of Use. Changes will be displayed to users upon their next login and must be acknowledged in order to continue using the platform.

Applicable Law

German law applies. Disputes relating to the use of the platform will be handled within the framework of the contractual relationship between nuuminds and the respective Client Company.
